PORTAL REGULATIONS www.krakow-apartments.eu
General information
- The Portal, www.krakow-apartments.eu, can be used by the Customer to make a reservation and pay the whole cost or just an advance for an Apartment offered on the web pages of this Portal. These Regulations define the rules according to which the Operator makes Apartment Reservations or provides other additional services.
- Tourist Agent Mikołaj Górecki, who conducts business under the name of Kraków For You Mikołaj Górecki with its registered office in 31-006 Kraków, ul. Grodzka 4, is the owner of the Portal. His name has been entered into the Register of Tourist Agents and Tourist Events’ Organisers of Małopolska Marshal with the number: Z/20/2009.
- All the information concerning the Renting Party are included in the Voucher and in the Regulations on the Apartment Rental, and in the Tourist Agent’s registered office.
- Apartment offers refer only to short-term stays, without meals, transportation, parking space and all other additional services, unless defined otherwise.
- All prices included in the Portal are the gross prices
- All receipts and invoices are issued by the Renting Party.
Definitions
Certain words and expressions used in this document have the following meaning:
- CUSTOMER – a natural person, a legal entity or an organization unit which has the legal capacity including the capacity to contract and which can use the services of the Operator.
- OPERATOR - Tourist Agent Mikołaj Górecki, who conducts business under the name of Kraków For You Mikołaj Górecki with its registered office in 31-006 Kraków, ul. Grodzka 4
- PORTAL – the webpage with the address: www.krakow-apartments.eu.
- RESERVATION – an order accepted by the Operator.
- VOUCHER- a document which confirms that the Customer has entered a contract/ made an order for a service via the Portal. Before the order is fulfilled, this document has to be presented.
- ORDER – electronic document which is the only possible form of an apartment reservation for a given period of time and for any other additional services booked via the Portal.
Reservation
- To make a reservation for an Apartment or for any other service included in the Portal the Customer fills in and sends a reservation form. The Operator is not responsible for the mistakes made by the Customer in the reservation form. The customer has to check all the data included in the form before sending it to the Operator.
- To make a reservation the Customer chooses an offer included in the Portal, marks the duration of his/her stay in the calendar, defines all other renting conditions and finally sends the reservation form. Next, the Customer shall pay an advance not lower than 15% of the total gross value of the reservation.
- The value of the reservation, which the Customer receives after making the Reservation and which is contained in the Voucher, is the amount paid by the Customer for his or her stay in the Apartment and for any other additional service. This amount shall not be increased unless it is required by the tax change or any other official payments.
- The Operator shall not demand any other payments for the Reservation. The Reservation Value shall contain no payments for any other additional services used by the Customer in the Apartment, which were not included in the Reservation, as well as no legally bounding health resort taxes, which have to be paid directly to the Renting Party.
- After paying an advance the Customer makes the Reservation. The Reservation obliges the Renting Party to provide an Apartment in compliance with the conditions defined in the Order.
- After paying at least an Advance in the amount defined in point 2 above the Operator shall prepare and send the Voucher to the Customer’s e-mail address. The Customer shall check whether the Voucher has been successfully delivered to his or her e-mail. If such document is not delivered the Customer shall immediately inform the Operator about it.
- The Operator does not guarantee a successful delivery of the Voucher to an indicated e-mail address, and, therefore, he is not responsible for the lack of the Voucher during the checking-in.
- In justified circumstances Customer may cancel his reservation not later than fourteen days before the beginning of the renting period by sending an e-mail on: anulacja@krakow-apartments.eu. The Reservation can be cancelled only via the cancellation forms available in the Portal. The Customer is liable to the following cancellation charges:

The difference between the Advance(or the whole value of the reservation) and the cancellation charge shall be transferred by the Renting Party to the bank account indicated by the Customer up to 7 days from the cancellation date. - After making the Reservation the Customer has the right to live in a chosen Apartment in a designated period. If the chosen Apartment is not available to the Customer the Renting Party shall only be obliged to indicate another Apartment of a similar but not lower standard. If that is impossible the Renting Party shall pay for Client’s stay in an Apartment of a similar but not lower standard.
- The Customer, if possible, can change his Reservation, not later than on the first day indicated in the Reservation. The changes can only be introduced via the forms available in the Portal.
- The change or cancellation of the Reservation are only binding after receiving a confirmation from the Operator on the e-mail address indicated in the Order. The Operator shall confirm the change or the cancelation of the Reservation within 48 hours from the moment of receiving such demand.
- The Operator has no obligation to accept the request for the Reservation change. If the Operator confirms the Reservation Change, he shall send the amended Voucher on the e-mail address indicated in the Order, provided that the Customer sends all the additional amount of the advance in accordance with the indications of point 2, if the Reservation Value has increased. The Reservation Change itself is made without any additional charges.
Arrival, stay, departure
- If the Customer shows his/her Voucher and pays for the entire stay and any other additional services, the Renting Party is obliged to provide the keys to the Customer in a designated time and date.
- The Customer shall inform the Renting Party about all damage, faults or other important issues connected with the Apartment the moment they occur.
- The Customer and all other persons who live in the Apartment shall bear combined responsibility for all faults and damage in the Apartment.
- The Renting Party shall discuss their check out (and key return) details with the Customer.
- Hotel Night is defined in the Regulations on the Apartment Use.
Payment
- The only possible currency is Polish Złoty (PLN). All prices expressed in other currencies which appear in the Portal, are the approximate prices, and are not binding for the Operator or the Renting Party.
- The advance or the whole value of the reservation shall be paid right after accepting the Operator’s calculation.
- Credit Card payments are available in the Portal.
Responsibility of the Operator
- The Operator shall make all the possible efforts to present true and current data in the Portal. These efforts, however, are strictly connected with the cooperation of the Renting Parties, which the Operator cannot guarantee. As a result, the Operator shall not be responsible for any unfaithful or outdated information about the Apartments (including data, descriptions, photographs, etc) which appear in the Portal.
- The Operator bears no responsibility for any inconvenience, disagreements or any other problems which occur during the Customer’s stay, and which are connected with repairs, renovations, temporary utility limitations, broken appliances of the Apartment and other works conducted outsider the apartment, etc.
- The Operator is not responsible for any acts of God.
- If the Operator bears responsibility, the total amount of his responsibility cannot exceed the amount of the Reservation Advance paid by the Customer.
Renting an Apartment – general regulations
Unless Regulations on the Apartment Use or the Agent’s offer stipulates otherwise, the following rules are binding:
General Remarks
- The Apartment is rented to the Customer only for residential purposes.
- The Customer cannot sublet the Apartment or lend it to any third parties.
- The Customer, while entering the contract, represents all the people who shall use the Apartment with him, though all the persons mentioned above share a combined responsibility.
- The price of the Reservation includes utility and cleaning payments.
- The Renting Party can require a deposit to be paid before entering the contract of the Apartment lease. The deposit shall be returned to the Customer on the check-out date if all the obligations in reference to the Apartment Renting Party are fulfilled by the Customer and all the other persons who share the Apartment with him or her. The Renting Party has the right to deduct all the claims and other payments from the deposit.
Obligations of the Renting Party
- The Renting Party is obliged to secure a normal use of the Apartment in accordance with the standard he has defined before.
- If due to unexpected circumstances, for which the Renting Party bears no responsibility, the Apartment cannot be used, the Customer has the right to use the substitute accommodation according to the provisions of the Regulations.
Obligations of the Customer
- The Customer is obliged to care for the Apartment. While entering the contract, the Customer confirms that the Apartment is in good condition, or if otherwise, he or she indicates all the failures. The Customer is responsible for all the damages caused by him or her during the renting period and is obliged to restore the place to its previous condition at his or her own expense, or to pay damages including the damages for the period when the Apartment cannot be used.
- In case of Apartment or furnishing devastation, the Customer is obliged to restore the Apartment and to conduct all the necessary repairs at his or her own expense or to return the costs of such procedures. The Customer shall additionally pay extra charge in the amount of a daily rental payment for every day when the Apartment cannot be used by the Renting Party.
- The Customer is obliged to leave all his valuable possessions in a safe of the Apartment or at the reception desk. The Renting Party bears no liability for the things left unattended in the Apartment.
- While leaving the apartment, the Customer is obliged to: switch off all electric appliances, close windows and lock the entrance door of the Apartment.
- It is strictly prohibited to smoke in the Apartment and on the premises of the building.
- Between 7 a.m. and 10 p.m. there is a period of quiet hours in the building.
Termination of the Contract
- If both parties agree, the Contract can be terminated at every possible moment,.
- The Contract can be immediately terminated if the Customer: does not use the Apartment in accordance with the Contract, causes devastation of the Apartment, repeatedly ignores the daily routine of the residential building and the needs of other inhabitants or neighbors. In such circumstances the Renting Party shall return the remaining amount of the rental payment deducing from it all the amounts stipulated above, including the payment for the Customer’s stay in the Apartment.
- The Customer has the right to terminate the Contract without any notice if the Apartment is useless for more than 24 hours due to a fire, flood, or any other acts of God, which are not the Renting Party’s fault.
- If it is impossible to use the Apartment, the Customer shall be entitled to the accommodation indicated by the Renting Party of the same or higher standard.
- If there is no such accommodation, the Customer shall be paid the amount of a daily rental payment multiplied by the number of days the Apartment cannot be used. [Final Remarks]
- All the Apartment’s flaws should be reported both to the Renting Party and the Agent of Krakow for you Agency right after their occurrence. All these problems can also be reported on a telephone number: +48 12 421 48 35 or +48 660 541 085.
- All the complaints concerning the Apartment should be directed to the Renting Party during the customer’s stay and sent to the Operator not later than 48 hours from the departure date. The complaints can be reported in the way stipulated in point s) above.
- The Operator shall decide on the complaint within 14 days from the date of its filing.
- Unless, Regulations on the Apartment Use stipulate otherwise, the hotel day starts at 2 p.m. and finishes at 10:30 a.m. on the final day of the Apartment Rental. If the Customer exceeds the rental time, the Renting Party may charge him or her for an extra day.
- All disputes connected with the provisions of the lease contract or in any way related to it shall be solved by the court having jurisdiction over the Apartment area.
- Matters not regulated herein shall be governed by the provisions of the Polish Civil Code and Polish Law regulations.

Final Remarks
- While placing an Order in the Portal, the Customer agrees to include his or her data into the data-base of the Operator. The data shall only be used for fulfilling the Order, making the Reservation and for marketing purposes.
- In the situation that a point of the Portal Regulations is no longer valid, the remaining points are still applicable.
- The Operator can freely change these Regulations at any time convenient for him.
- The Customer has to familiarize with the provisions of the Portal Regulations before placing an Order. The Customer who places an Order in the Portal, automatically agrees with the Portal Regulations, unless he states otherwise. If the Customer does not accept these Regulations, an agreement concluded in writing or via e-mail among the Customer, Operator and the Renting Party is in force.
